General terms and conditions for using the Everifin payment method
1. The Everifin payment method is a payment initiation service (hereinafter only as the "PIS") whereby a payment order (hereinafter only as the “PO”) is sent to a customer's bank with a customer's consent to make payment of the relevant price for the purchase.
2. The PIS service shall be provided by the company EVERIFIN, s.r.o., with registered office at Mikovíniho 8, 917 01 Trnava, Company ID No.: 46 963 774 (hereinafter only as "Everifin"). Everifin is an authorised PIS provider under the licence granted by the National Bank of Slovakia No. 100-000-296-557 registered in the register of the National Bank of Slovakia: https://subjekty.nbs.sk/entity/3999/. 3. The supervisory authority over the provision of the PIS service by Everifin is the National Bank of Slovakia, with a registered office at Imricha Karvaša 1, 813 25 Bratislava. The contact details of the supervisory authority are as follows:

4. When using the PIS service by the customer, Everifin as the PIS provider, shall ensure the automated filling in of the relevant payment data into the electronic form to send the PO to a customer's bank, where a customer has a payment account. A customer confirms the correctness of the payment data and the consent to send the PO to his or her bank by clicking on the "Pay now" button. At the moment of consent by the preceding sentence, a contract for providing a one-off payment service shall be created between a customer and the Everifin.
5. After a customer has consented to the sending of a PO by the previous section of this clause, Everifin shall submit a PO to the customer's designated bank for the execution of a payment operation consisting of the transfer of funds in the amount of the relevant purchase price from the customer's designated payment account to the payee payment account. From the moment the order is submitted to the customer's bank, the processing of the order is subject to the terms and conditions of the customer's bank. Everifin shall not be liable for the result of the processing of the PO or for the date of execution (settlement) of the payment operation under the PO, except as provided in paragraph 11 below.
6. To authenticate a customer, a customer shall be requested to proceed according to the instructions of the respective bank of a customer, which maintains the individual payment account of a customer, through which the payment operation is to be carried out by the submitted PO. A customer's authentication (including strong authentication) shall be carried out either in a redirect to the internet portal of the respective bank (secured directly by a customer's bank) or in a redirect to the internet portal of Everifin (operated by the Everifin) or embedded the portal of the payee (operated by the provider of the portal), following the preceding sentence. Depending on the authentication method, the Everifin itself may obtain some identification data of a customer in connection with the provision of the PIS, even though it shall not carry out any specific customer authentication unless agreed otherwise.
7. Upon submission of the PO to a customer's bank under paragraph 4, Everifin shall inform a customer whether a customer's bank has accepted or rejected the PO immediately after the Everifin receives such information from a customer's bank (as the provider of the payment service consisting in the execution of the payment operation under the PO).
8. The provision of the PIS by the Everifin through the payee’s portal is free of charge to a customer.
9. The maximum time limit for the execution of the PIS based on a customer's consent is 30 seconds.
10. In case of currency conversion between a customer's payment account and the payee payment account, the standard interbank exchange rate shall be used.
11. Everifin shall be responsible for ensuring that the provision of the PIS to a customer is not affected by technical errors and that the PO is submitted to the respective bank of a customer promptly and with the correct content.
12. A customer acknowledges that the actual payment operation by the submitted PO is carried out by the respective bank that maintains the payment account for a customer. The execution of the payment operation shall thus be governed by the terms and conditions of the respective bank as the payment service provider that maintains a customer's payment account. The individual relevant bank of a customer is responsible for the successful, timely and correct execution of the payment operation.
13. Everifin shall not be liable for any damage that could be caused to a customer by not being able to use the PIS at any particular time.
14. A customer may provide Everifin with special consent to save the connection to a customer's payment account used in connection with the provision of the PIS to deliver future PIS. A customer shall provide the consent by confirming the relevant form (with the "Remember my account for faster future payments" checkbox enabled) in Everifin's user interface to which a customer shall be redirected. After giving consent according to this paragraph, Everifin shall save a customer's identifier and data about the used customer's payment account via virtual token in Everifin's internal database and on a customer's device (PC, mobile, tablet etc.) through which the consent was given. Suppose a customer provided consent according to this paragraph, in case of any future payment via the Everifin payment method using the same customer's device. In that case, a customer shall acquire simplified access to PIS (without needing to specifically select the customer's payment account and in case a customer's bank allows it, without needing to log in to the customer's bank internet banking). By giving consent according to this paragraph, a customer also agrees that Everifin can provide the virtual token with the customer's identifier and data about the used customer's payment account to provider of payee’s portal to acquire simplified access to PIS for a customer in connection with the future payments on the portal.
15. Everifin shall not be entitled to assess whether a customer is entitled to make payment operations against the payment account designated by a customer in connection with using the Everifin payment method.
16. The customer confirms that prior to giving consent to the provision of the PIS, the customer has gained knowledge of the information on the processing of personal data by the Everifin available at https://www.everifin.com/return-policy
17. Everifin shall provide a customer with the following information after the execution of the PIS upon a customer's consent:
- confirmation of the successful submission of the PO from the payment service provider that maintains the payment account (a customer's bank),
- a link allowing a customer to identify the payment operation as well as any information received in connection with the payment operation,
- the amount of the payment operation,
- statement that it is a free-of-charge operation.
18. Legal relations arising from or related to the contract for providing a one-off payment service between a customer and Everifin shall be governed by Slovak law. General courts of the Slovak Republic shall have subject matter and local jurisdiction to hear any and all disputes that may arise in connection with the contract for providing a one-off payment service between a customer and Everifin except when the customer is in the position of a consumer, when the jurisdiction shall be determined according to generally binding legal regulation.
19. A customer shall be entitled to make any complaint of the PIS against Everifin in writing at the Everifin's registered office or by email to Everifin's email address stated in paragraph 2. The detailed procedure for making a complaint against Everifin is set out in the Everifin's complaints procedure, which a customer has gained knowledge of before agreeing to the provision of the PIS.
